Death Under The Patio

Brian Lee Clements

It’s been about three weeks since Jack Donovan had shoulder surgery.  It turned out that the shoulder and rotator cuff was so bad that they had to do Reverse Shoulder Replacement.  It's what it sounds like.  The ball and socket in the shoulder are reversed. Hurts like hell but hopefully this will be the end of his shoulder problems.

During the last couple of weeks, Jack had been sleeping in his Lazy Boy Recliner.  He couldn’t sleep in bed because it was necessary to be on his back to support his arm, which he was unable to do.  Jack always has always been the type that  slept on his stomach. Sleeping in his recliner made it easy for him to support his shoulder on the armrest. Plus, his wife made sure he had an extra pillow to rest his shoulder.  But he did miss sleeping on his stomach

Well, during this downtime, Jack started getting a little antsy again and decided to go back to work as a private detective.  Luckily, he didn’t have to go too far since his office is at home.

That morning, Jack got up early as usual and prepared Kate’s toast and coffee before she came downstairs.  Today, she decided to wear her turquoise scrubs.  After she came down, she put her tennis shoes on and then started looking for her purse. She's always misplacing it somewhere in the house.

“Honey, have you seen my purse?”

“It’s right where you put it. On the chair in the kitchen.”

“That’s right. I always forget.”

“You seem a little distracted today. Everything okay?”

“I’m good. All I need is to get my two cups of coffee and my toast and I’m ready to go.

“I’m happy.  Don’t want a tired surgeon operating today.  Hopefully you won’t see me there today.”

“Why should I?  What are you planning?”

“Nothing really. Just going to do some work in the office.  Can’t drive yet. So, hopefully no distractions.”

“Afraid you’re going to have a big distraction today, babe.”

“How’s that?”

“They start working on the new patio today, remember?

“They are?  Is that today? I forgot. Thank goodness I won’t be able to hear them.”

“You’re lucky with that.  On the other hand, Hanz and Franz will have a fit watching the workers.”

“They’ll be fine.  It’ll be good for them to get their heart rate up.”

“Not too much.  I don’t want them to get hoarse like when we had the roofers here a few weeks ago.”

“I don’t remember much about that.”

“You were on Percocet at that time when they were doing the roof.  That stuff really helped you with the pain and your sleep.”

Before Kate left, they said a quick morning prayer and kissed each other goodbye. She then leaned over and petted the dachshunds.

“Now behave. I don’t want you to hurt yourself.”

“I’m sure the dogs will be fine.”

“I’m talking about you. See you this evening.”

Kate then patted Jack on the chest and grabbed her toast and coffee. After he got his wife off to work, Donovan went to his office and opened his email. He noticed that he had about 100 work emails that he needed to catch up on.

“At least it isn’t 1,000 emails like some people get” Jack says to himself. “Let’s see. Nope,

Nada, spam, whoa, definitely spam.  What’s this?

Mr. Donovan.

We were hoping you would be able to help us find our son and daughter.  They have been missing since 2001 from Toledo,Ohio and we believe that they were last seen in Colorado Springs.  They’re fraternal twins and were almost inseparable.  Their names are John Jr. and Jasmine. Nobody will help us.  Please call us at 208-555-0168 or email us.  We are somehow looking for closure. Hope to hear from you soon.

John and Julia Jacobson

Jack started thinking to himself, ”Let me get this straight. John and Julia are looking for John, Jr. and Jasmine.  And, they’re asking Jack to help them. Sure are a lot of J’s.  Surprised they didn’t find them in a Juniper Tree in Jacksonville. And why wait eighteen years?  Might be an interesting case.”

Before he answered the email, the doorbell light started flashing for the front door.  When he got to the door, he noticed that Hanz and Franz were having a hissy fit.  After yelling at them, they calmed down, climbed onto the couch and looked curiously out the front window.

Jack cautiously opened the door and saw a business truck out in front of the house.

“Hi, I’m Jack Donovan. You guys must be from the patio company.

“Yes, sir, I’m Mr. Jake Johnson. These are Jose and Javier. They’ll be assisting me on your project.”

Jack noticed that Jose is Javier had blond hair and blue eyes

“Where are you two from?  Excuse my ignorance. But, you don’t look hispanic.”

Jose answers, “That’s okay. We get that a lot. Our parents are from Spain. We are actually cousins and our parents started this company 20 years ago.”

“Wow. That’s interesting.  Before you get started, I just want to let you know that I am totally deaf. But, I can read lips pretty well.

“Your wife already explained that to us. She also said you have a knack for getting into situations that you have difficulty getting out of.”

“Really?  I would think that my wife would be getting used to that by now.  Hopefully I can change that habit.  The dogs shouldn’t bother you too much.”

“They should be okay. What are their names.”

“Hanz and Franz.”

“Really,” In unison, Javier and Juan say, “We’re going to up.”

After talking, the workers got their equipment and headed to the back yard where the old patio is.  In fact, it was still the original concrete patio when the house was built in 2001.  Jack then went back to his office and wrote an email to the Jacobsons.

After he finished writing the email, the dachshunds started looking at him and cowered under his desk.  They’ve been acting kind of skittish since the windstorm damaged the roof a few weeks ago and when the repairs took place.  Almost like PTSD.  Jack then headed downstairs to get a snack for him and the dogs.  As he was in the kitchen, he looked out in the back and noticed that the workers were using a jackhammer.  No wonder Hanz and Franz were acting that way.

“Okay guys. Don’t tell mom.”

Jack gave them each a slice of cheese to calm their nerves.  Probably not a good thing to give them, but they seemed to love it and gobbled it down pretty quickly.

In the meantime, Sam, their daughter, came downstairs still in her pajamas. She was a little upset that she didn’t get her twelve hours of sleep that most teenagers try to get.

“Dad, what are they doing out there?”

“They’re replacing the patio. Didn’t your mom tell you?”

“Yea, but I didn’t think they would be starting at this ungodly hour..”

“It’s already eight o’clock. You can get caught up with your sleep later. Right now, eat your breakfast and go take your shower.”

Jack then headed back upstairs to work. That’s one good thing Jack liked about being deaf.  Noise doesn’t bother him. But, sometimes he missed certain noises like the voice of his family or even the sound of a train whistle and the noise of the tracks..

A few minutes later, Jack noticed the doorbell light going off and he headed back downstairs to see who it was. When he opened the door,  Mr. Johnson was at the door visibly shaken.

“Mr. Johnson, is everything ok?”

“No sir.  We were jackhammering the patio and we came upon something very bad.”

“What is it?”

“I’ll have to show you.”

They went through the house to the back and when he opened the French doors, he saw what all the commotion was all about.  Jack looked down and saw a tarp with a human skull sticking out of it.  It looked like it had been there for some time.

“I’ll notify 911” Jack said.

“What? How?” Johnson replied.

“They receive text messages now.”

“911, Are you receiving my message?”

“This is 911.  Yes, we are.  What is your emergency?”

“I have some workers who found some human remains under my patio.”

“How did they find it?”

“Jackhammer.  Looks like it’s been here for quite some time.”

“Springs Police Dept has been notified, Mr. Donovan.”

“Thank you.”

“You’re welcome.  How’s the shoulder from a few weeks ago?”

“Healing up slowly. Thanks for asking.”

At that time, a fire truck pulled up to his house, which really didn’t take long.  Plus the fire station was only about a couple of miles away.  They probably also had his address in the gps as a frequent user..

“Fire truck just arrived. Thanks for your help.”

“You’re welcome, Mr. Donovan.”

Jack met the EMTs and firemen at the door and directed them to the back through the side gate.  A police car also showed up and then three more.  Looked like another slow day. But then most of the officers knew Jack from when he was a detective on the force.

Jack went to the back patio when Sam came down to see what was going on.

“Dad, what did you do?”

“I didn’t do anything.  Thanks for the vote of confidence.”

"I’m sorry.  But, when I see fire trucks and police coming, I never know what to think.

“The workers found something under the back porch.”

Sam seems more interested. “What did they find?”

“I’m afraid they found some human bones.”

“Can I see?”

“Afraid not. Your mother wouldn't want you to see it.  However, you can look down from one of the second floor windows, then I would have to tell your mom that I know nothing.”

“Thanks dad.  Wait till I tell my friends about this.”

“No pictures.  This could be another addition to your “What My Dad Did This Summer’ school report.”

“Great idea, but I don’t think anybody would believe any of it.”

As Sam headed upstairs to the spare bedroom to see what was going on, the doorbell rang and she stopped to open the door.

“Dad!” Sam yelled out. “More police are here..

Realizing that her dad didn’t hear her, she tapped him on the shoulder and pointed to the door.  She then quickly headed upstairs so not to see any more police and to get a better view.. Jack walked to the front door as she headed upstairs and started talking to the officers.

“Hi, Jack.” the first officer said.

“David, how is it going? Haven’t seen you in a while.”

“That’s a good thing. Right? I see that the dog poop is cleaned up. Will be easier to find the key next time.”

“Don’t remind me. Everything is in the backyard. You can come through the house or go around.”

The officer tells his partner, “ A few weeks ago, he was held hostage by a gunman looking for a flash drive or something.”

“How did he get out?” the other officer asked.

“Jack got a phone call from his wife and the gunman told him what to say.”

“What does that have to do with it?”

“Jack is completely deaf and never answers the phone. He didn’t understand a single word his wife said. She knew something was up and she called Jack’s old supervisor.”

“I heard about that. Smart thinking.”

“Yea. I wish I did think of that. I still don’t know what she said.”

Jack led the officers to the side gate.  He didn’t want his wife to complain about all of the footprints on the carpet.  The officers then set up a perimeter so the evidence would not be disturbed.  Afterwards, the detectives came and started looking at the body and tried to figure out who the person was, how it got there and when.

At that time, Jack got a text from his wife.

“Hi honey.  How’s it going?”

“Hi.” Jack responded. “You’re not going to believe this.”

“Try me.”

“The police are here.”

“What? What did you do? Are you ok? Why are they there?”

“Well, the workers found some bones under the patio that they were tearing up.”

“You’re kidding me?”

“Afraid not. The police are out back looking at the evidence right now..”

“How long do you think the body has been there?”

“Probably 18 years when the house was built.”

“How’s Sam?”

“She’s already up and eating her breakfast upstairs trying to watch what’s going on.”

“Ok. Hopefully it’ll curb her curiosity.”

“Doubt it. I’ll let you know what happens when I hear something.”

“Is that supposed to be a joke?”

“Sort of.  I’ll let you know what happens.”

“Ok.  I’ll call Sam and tell her you ratted on her.”

After finishing texting with his wife, Jack decided to go through the side gate to get a better view of what is going on. The detective saw Jack and decided to ask him some questions.

“Hi Bob. How’s it going?” Jack says.

“Hi Jack.  Imagine seeing you here.”

“I know what you mean.  Surprised as hell too.”

“How long have you been living here, Jack?”

“We bought the house back in 2001, a few months after we moved here from Florida. Brand new when we bought it”

“Would you have any idea who this might be.”

“Not a clue. Back then I just started working with the Springs Police Department.”

“Okay. Guess we’ll have to check out the missing person’s reports from 2001.”

“Now this is strange. I just received a request from a couple in Toledo looking for their kids.  who’ve been missing since 2001, around the time the house was built."

"Ohio? Can you get us the information?"

"Sure. I'll print you a copy of the email."

“Thanks Jack”

A few minutes later, Jack comes down with a copy of the email and hands it to Bob. As he read over it and Bob starts mumbling to himself’

“There sure are a lot of J’s in their names.” He then turned to Jack, “Thanks Jack.  I’ll give them a call and see if we can get some dental records or DNA samples”

“You’re welcome.”

After the detective left, Jack yelled out to Sam, who was still watching the action from the second floor window.

“Sam, could you take the dogs out for a walk.  I don’t want them to get in the way of the investigation.  They may think those are big bones for them to chew on.”

“Jeez, it sure is taking the police a long time to do something.  Was your job always this boring?”

“No Sam. Maybe just a little more boring than this.”

“Wow.  Come on, guys. Time for your walk.”

Hanz and Franz were so excited when they went to the door for their walk. Sam had an especially hard time getting the leash on them as they were jumping all over the place. They almost peed all over her. They usually didn’t have a chance to go out on walks much since they had a fenced in yard and this was a special treat for them.

After they left, Jack started watching the investigators comb through the sand and evidence in the backyard.  As they were looking, Jack noticed a necklace and bracelet on a couple of the bones.  Trying to be discreet, he took a picture on his phone of the items and bones that were in the ground.  He then took the phone up to his office and downloaded the picture on  his computer to enhance the picture and get a better look at it.

Jack started looking at the items and noticed that the bracelet is a Medic Alert Bracelet as is the necklace.  That should make it easier to identify the person.  That is, if they still have records from  back then.  Unfortunately, the number is too blurry to read.  Maybe Jack could get a closer picture without being caught.  He just came up with a great idea.

As he was looking outside, Jack decided to open one of the french doors.

“Hey, guys, it’s a little stuffy inside so I’m going to open the door so I can get some fresh air.  Is that okay?”

“One of the technicians replied, “As long as you don’t interfere with the crime scene.”

“I’m staying inside.”

About five minutes later, Sam brought Hanz and Franz inside after their walk.  They were still excited from their walk that when they got off the leash, they ran towards the back door and jumped out into the back yard.

At that time, Hanz grabs one of the foot bones in his mouth and runs off.

“What the hell?! Yells out one of the technicians. “Grab the dog.”

What the technicians didn’t know was that Hanz loved to be chased.  He kept running around with both technicians chasing after him.  While that was happening, Jack grabs his phone and takes a quick picture of the number on the necklace.  Hopefully, the techs didn’t see him with his phone.  After three quick pictures, Jack calls out to Sam, who was standing in the kitchen watching everything.

“Sam, could you call Hanz to come back inside.”

Sam yells out, “Come on boy.  I have a treat for you.”

At that time, Hanz dropped the bone as he scampers to the house.  Sam then gave both dogs a treat of cheddar cheese.

“Thanks, Sam.”

“What did you just do?”

“I’ll tell you later.  It may help solve this case.”

Jack looks at Hanz, “You deserve another slice of cheese for your good deed.”

“Mom’s not going to like getting all this cheese.”

“They’ll be fine.”

Jack quickly went up to his office and uploaded the picture to his computer.  In the meantime, he found an enhancement program so he could see the number on the necklace.  And there it was. A six digit number with an allergy alert for the person that owned it.

He then emailed Medic Alert for some information about the client.  He also emailed The Jacobsons to see if either one of the kids had a severe allergy to anything.  He thought it might be a long wait but they responded within five minutes.

Mr Donovan,

Thank you for your quick response.  Neither one of our kids had an allergy that we know of.  Jasmine’s boyfriend had a severe allergy to penicillin .  He had one of those necklaces and bracelets because he almost died when he was given some.  Her boyfriend was named Jake and he disappeared about a month after the twins went missing.  We just thought of it being a coincidence.  But nobody has seen him since 2001 either.

Julia Jacobson

Now that was interesting.  In law enforcement, there’s no such thing as a coincidence. Jack remembered that the foreman for his patio is named Jake.  Not sure where he is from, but he’ll find out.  In the meantime, Jack goes to the kitchen and notices that the technicians are wrapping up and removing the body. What a relief. His home will be back to normal and the workers can start back up.

At that time, the doorbell light came on and Jack checked to see who was there.  Jose was at the door and looked confused.

“Hi, Jose. What’s going on?
“Hi, Mr. Donovan. Jose responded. “Have you seen or heard from Jake? He drove off about thirty minutes ago and hasn’t returned. Starting to get a little worried.”

“Has he ever left you guys before?”

“Never.  Called my dad and he’s sending somebody over to come get us.  We’ll start back up tomorrow morning with either Jake or another foreman.

“Ok. See you tomorrow then.”

Now Jack is thinking that this was weird.  Why would Jake leave all of a sudden like that.  Was there an emergency?  So many questions.  But no answers.  Jack decided to check his email and get an answer that he didn’t want.  It was from Medic Alert.

Dear Mr Donovan,

Due to the restrictions of HIPAA and patient confidentiality, we are unable to give you the information that you request.  Thank you for your inquiry.

“Blah, Blah Blah.” Jack said to himself, “Maybe Kate can help me.”

Jack then quickly texted Kate.

“Hi, babe. Can you do me a favor?”

“Sure, as long as I don’t have to break the law or see you as a patient in the E.R.”

“I don’t think you have to worry about either of those things.”

“Good, what is it?

“Could you get some information on a Medic Alert bracelet. The number is 6954…”

“Where did you get this?”

“The body had a necklace and bracelet on it.  Just trying to figure out who the person was.”

“I just got onto the medical side of the website.  Give me a couple of minutes.  Got it...It belongs to a Jake Johnson.”

“Really? Does it say when he passed away?”

“This is the weird part.  The account is still active.”

“What does that mean?”

“That person is still paying for the service.”

“You’re kidding. Then who’s body is that under the patio.”

“Well, honey. That’s what the great Jack Donovan has to figure out. Have another surgery coming up. L.Y.”

“Love you too”

Jack started thinking out loud to himself. “What the heck is going on around here? I wonder if that has anything to do with Jake, the foreman. Jose and Javier are still here.  Maybe I can ask them some questions.”

“Hey guys. Can I talk to you for a moment?’’

“Sure,” Juan yells out. “What do you need.?”

“What can you tell me about your supervisor, Jake?”

“He’s been with the company for about nineteen years.”

“Is he married?”

“Yes, he is.  Never met his wife before.  Heard she was in the mental hospital down in Pueblo.

“I heard that too,”Javier added.

“How long has she been down there?”

“About 15 years from what I understand.” Juan says.

“What’s her name?”

“Jake calls her Jazzie.  Don’t know what her real name is.”

“Really? Thanks a lot.”

“See you tomorrow.”

Jack decided to follow a hunch and drive down to Pueblo and visit the State Mental hospital down there.  But first he texted his wife to let her know.

“Hi honey.  I’m going to be driving down to Pueblo to follow up on a lead.  I know I shouldn’t be driving, but this is very important.”

Jack snapped his finger and remembered that she is probably in surgery right now and can’t respond.  So he decided that he better go and check this new lead out. He figured it’ll be easier to seek forgiveness than ask for permission.  Hopefully he didn’t forget how to drive.

He told Sam what where he’ll be doing and she just shook her head. As he headed south on I-25, Jack decided to stop by Chick Fil-A and pick up some nuggets and sweet tea to have on the way. It just took about fifty minutes to drive to Pueblo and another 15 minutes to find the place.

After pulling up into the parking lot, Jack looked around at the cars to see if he recognized any of the cars there and, sure enough, there was one truck there that looked familiar. That was the truck that Jake was driving for the company he worked for. Wonder what he’s doing there

Jack went to the front desk and started talking to the receptionist and security people,

“Hi, I’m Jack Donovan.  I was wondering if you could help me?”

“Sure. Are you a resident here?”
“No,” Jack says sarcastically,  “I’m a private detective. I’m trying to find somebody who may be a resident here.”

“What’s the name?”

“The person I’m looking for is Jake Johnson.  He or a relative may be a patient here.”

Another security person showed up and looked at the person helping Jack.

“George,” He said, “How many times do we have to tell you that you can’t dress up as a security officer.  You’re a patient here.  The other security officer will take you to your room. Okay?

“Nice meeting you,” George said to Jack, “Jake is here seeing his wife, Jazmine.”

“Thank you George,” Jack answered back

“Sorry about that sir,” the officer said.

“Quite alright.  Believe it or not, this is not the oddest thing I’ve seen in my career.”

“How can I help you, sir?”

“As I was telling George, I am looking for Jake and Jazmine. George mentioned that he saw Jake here earlier.”

“Yes, he is here.  I’ll need to see some identification.”

As Jack handed the security guard his I,D., Jack started to wonder how Jazmine ended up at the state hospital.  This case was getting more bizarre as the day went on.

“Thank you Mr. Donovan.  Here’s a badge for you to wear.  Please keep this on you at all times so they won’t get you mixed up with the residents.”

“That’s all I need.  I can see me texting my wife about being stuck in here.”

After he got the room number, Jack started walking down the hallways and began wondering how all these people ended up here and the choices they made if they will ever get out. Very sad.

When he got to the correct room, he saw Jake and Jazmine holding hands talking to each other.

“Hi, Jake. Wonder if I could talk to you for a few minutes.”

“Sure,” Jake turns to Jazmine, “Babe, I’ll be right outside talking to the nice man.

Jazmine shook her head and looked out the window of her

“‘I’m just trying to figure out what the heck is going on. I received an email this morning from Jazmine’s parents and everything turned are hellter skelter on me. Can you tell me what’s going on?”

“I guess you heard that Jazmine and I are married.”

“I heard that earlier from your coworkers.  They also told me that she was down here.”

“She and her brother came here about 20 years ago to seek no adventures, so she said. It didn’t go well.  When they got here, they had no money, place to stay or anything.  So John decides to get involved in one of the gangs here and to use Jasmine in one of the prositution rings in Colorado Springs.”

“She called me about a month later and she wanted to come back home but her brother wouldn’t let her leave.  She went into hiding and told me where she was.  When I got here, we tried to stay in some of the foothills parks on the west side of town until her brother got tired of looking for her, but he never did.”

“One night, it came to a head and we had a fight at one of the building sites which turned out to be where you live. He came after me with a knife.  I did what I needed to do to protect ourselves.  Unfortunately he died while I was doing that.  We buried his body where they were doing the patio.”

“We tried to make a life together, but she had a nervous breakdown back in 2008 and has been here ever since then. I forgot which house his body was buried and freaked out when I saw him this morning.”

“Why did you put your Medic Alert items on him?”

“Just in case they found his body.  When they didn’t find it, I thought we were in the clear.  Until today. I don’t want anything to happen to Jazmine. She’s been through enough already.”

“I’ll need to notify the detectives what I found, but I don’t see them bringing any charges against you or your sister.  To me, it looks like self defence. Plus the two of you have already been through a lot.”

“Thank, Mr. Dononvan.”

As Jack headed towards the exit, he realized that decisions that make in their lives affect them forever.  As he is walking, he bumped into a few people and headed to the security post, he notices that his badge was missing.

“I just lost my badge.” Jack told the security guard.

“Do you have any I,D.? the guard asked.

“Uh, Oh.” as he patted himself looking for his wallet. “I can’t find my wallet either. I bumped into some people earlier and they must had picked it off of me.  My keys are missing too.”

“What’s your name?”

“Jack Donovan.”

“The sign out sheet says he left five minutes ago, Are you sure you're not a resident, sir?

“You can also call my wife. Oh no.  My phone is missing also.”

“Sir, which room do you belong to?”

“What?! I don’t belong here”

At that time, two orderlies came up and grabbed Jack to take him to a room to find out where he belongs.  In the meantime, the security officers find out that George, the resident that Jack met, was missing at the time and probably had his car.  So, Jack had to wait and see when he could get home

In the meantime, Jack explained to the officers about his disability and also asked the security officers to contact his wife so she won’t worry about him.

After everything got cleared up, he texted his wife and tried to explain to her what happened.

“Hi, honey. Guess you heard.”

“Yes, I did. Asked them to keep you there overnight. They said they didn’t want you.”

“Thanks.  Should be home in about an hour.”

“Ok. See you when I get home.  I want to hear everything. Love 968.”

“Love you too.”

Love 968 was the code Jack and Kate would use when first started texting each other with their first phones.

About two weeks later, the workers were finishing up and Hanz and Franz already had a chance to christen the deck.  It turned out that Jake and Jazmine would not be charged for the death of John, Jr. But, there is the charge of tampering with evidence.  On that charge, The D.A  decided that he will not pursue jail time if they pleaded guilty. Just probation so Jasmine can get the help that she needed.

Jack is out on the deck happy that everything was done and looked great.  Sam came out to the deck and tapped him on the shoulder.

Hey dad? Mom just called.  She said she's bringing home a guest."

"Who is it?"

"She didn't tell me. But she said she’d text you everything."

At that time, Jack's phone vibrated and he looked at the message. He smiled at the dachshunds and gave them a message.

"Guys? We have company coming. A relative of yours from the old country. Mom is bringing him home, so you better behave."

Hanz and Franz let out a little whine.

A few minutes later, the garage door opened and Kate slowly entered the kitchen with the new guest.

"Mom, he's adorable." Sam shrieked.

In her arms, she was holding a six week old German Shepherd.

Now they have two dachshunds and one German Shepard. And, Jack, He  wondered what his next case will bring him. Can it be any more exciting than what he’s had.  Only time will tell.

Enjoyable crime thriller short story.
It is as good as the other books.

Enjoyable though a bit 'choppy.' It needs some more description, maybe some more research. The sentences are not long enough either. But you held me with your plot and it was very interesting. Altogether, it was a pretty good read.
