330 Jay Street Part 3

 

Mrs. Donovan reports for work to find a process server waiting in front of her office.  The man has her sign for the papers then leaves.  After reading the papers she calls Mike Carter, her building maintenence man into her office.  "What the hell happened the other day with that exterminating job?!?" she asks.  "Mrs. Lifschultz is suing us and the exterminating company for 75 million dollars, claiming one of you stole some kind of figurine and caused her severe emotional distress!  She also claimed you both threatened her!  To make matters even worse she took out an order of protection against you and a restraining order against me!  Now I can't send you back into that building or go there myself to collect rents!  You'd better have a damn good explanation!"

 

"Mrs. Donovan" Mike replies "That lady is crazy!  Yesterday I met up with Diego from the exterminating company.  We went in and sprayed all six apartments per instructions.  She started yelling and screaming at us about how we stole some Hello Kitty figurine she had on the mantle.  Neither Diego or I saw it.  That old bat is crazy and probably senile!  I've worked for you for years and never once have I stolen anything from anyone.  I've got a family to support.  Do you think I'd risk losing my job over some figurine I wouldn't know the value of or for that matter where to sell it to?  Also at no time did Diego or myself threaten her in any way.  When we finished the job we just walked out of the apartment to not provoke any further hostility from her.  You can call the exterminating company and ask Diego if you don't believe me!"

 

"I'll do just that." Mrs. Donovan says. " In the meantime you don't go anywhere near that building until further notice.  I mean it!  I'll have one of your co-workers cover any repairs or maintenence issues there until this matter is resolved.  Unfortunately because of the restraining order I am not allowed to even call Mrs. Lipschultz to try and work something out of court."

 

After Mike leaves Mrs. Donovan calls Ace Exterminating Co and asks to speak to Diego.  Advised that he is out in the field exterminating another property she speaks to Joe, his supervisor.  "Joe, this is Mrs. Donovan from Premier Building Management.  You did work for us the other day at 330 Jay Street and I'm afraid we have a problem."

 

"Tell me about it!" Joe answers.  "We just got served court papers the other day.  Your tennent Mrs. Lipshultz is suing us for 75 million dollars claiming my exterminator stole some kind of figurine.  I've known and worked with Diego for over 10 years.  He has never been accused of stealing anything.  Now I can't send him to the area around that building because she took out an order of protection against him!  Its not just Mrs. Lipschultz either.  You've got some pretty horrible tennents living in that building.  We're going to fight this in court and would like your cooperation.  Your maintenence man was with Diego the entire time he was physically in the building.  If he is willing to testify in court that he didn't see Diego take anything it would be a great help."

 

"I think that can be arranged" Mrs. Donovan replies.  "If you can arrange for Diego to meet my lawyer in my office to take a sworn deposition I'll have Mike Carter do the same for you.  If they both testify that neither of them saw or took that miserable Hello Kitty figurine we may be able to get the case dismissed.  I'm really sorry about this and do have more work for you at other properties I manage.  But there is no way I'm letting Mrs. Lipschultz win the Ghetto Lottery."
